refurbed is the marketplace, you are the Seller
refurbed operates an online marketplace that connects Sellers with Customers. When a Customer purchases a Product on refurbed, the purchase contract is concluded directly between you (the Seller) and the Customer. refurbed does not become a party to that contract - refurbed acts solely as an intermediary platform and collects a commission for each sale.
This means you bear responsibility for all obligations arising from the sale, including product quality, accuracy of product information, delivery, and compliance with applicable consumer rights.
You are responsible for defects and warranty claims
Because you are the contracting party, any warranty claims whether under the contractual Seller Warranty or under statutory law are directed at you. You are responsible for inspecting returned Products, carrying out repairs or replacements, and issuing refunds where required. refurbed may facilitate the process (for example, by registering the claim and providing a return label system), but the underlying obligation to remedy defects rests with you.
You must comply with all applicable laws
As a Seller on the refurbed marketplace, you must comply with all laws and regulations applicable to your activities in your own country and in every country to which you ship Products. This includes, in particular, consumer protection law, product safety and compliance rules, data protection, tax obligations, and environmental regulations. It is your responsibility to stay up to date and adapt to changes in the law.
You are bound by the Seller Guide
The rules governing your relationship with refurbed are set out in the refurbed Seller Guide, which you sign electronically during onboarding. The Seller Guide forms an integral part of the contractual relationship between you and refurbed. It includes the obligations described above as well as operational requirements such as shipping timelines, customer service standards, return and refund procedures, and fraud prevention measures.
